Acceptable Use Policy
By using USDC, EURC, or USYC (collectively, “Circle Digital Assets”) or applying for, accessing, or using products or services (collectively, “Services”) provided by Circle Internet Group, Inc. and its subsidiaries (collectively, “Circle,” “we,” “us,” or “our”), you agree to be bound by this Acceptable Use Policy (“Policy”).
This Policy is subject to change at any time without notice, and the changes will be effective when posted. Your continued use of Circle Digital Assets or the Services indicates your acceptance and agreement to the Policy changes.
1. Purpose. We build the infrastructure for a more open and inclusive financial system. We aim for Circle Digital Assets and our platform to be broadly accessible to support the digital economy, like other forms of infrastructure. At the same time, we must adhere to applicable financial laws and regulations, including with respect to Services provided by our regulated entities, and we must operate within the framework of applicable laws and the requirements of our bank partners. This means we are not able to support all types of activities and businesses, as set out in this Policy.
2. Prohibited Users. You may not use Circle Digital Assets or any Services provided by Circle if any of the following apply to you:
a. You are organized under the laws of, ordinarily resident in, or located in a country or territory that is the subject of comprehensive trade and economic sanctions maintained by any governmental authority of the jurisdictions where we hold licenses, which can be found on the Licenses page here (collectively, “Restricted Territories”);
b. You are (i) designated on a sanctioned parties list administered by any governmental authority of the jurisdictions where we hold licenses or (ii) 50% or more owned or controlled by the government of a Restricted Territory or by one or more such sanctioned parties (collectively, “Restricted Persons”); or
c. You intend to transact with any Restricted Territories or Restricted Persons.
3. Prohibited Activities and Business Types. You may not use Circle Digital Assets or any Services provided by Circle to engage in activities that:
a. violate, or assist in the violation of, any applicable law, statute, ordinance, or regulation (including, but not limited to, any operation of financial businesses or money services businesses without requisite licenses or regulatory approval or any gambling or betting activity that is illegal under applicable law), or other activities that involve proceeds of any unlawful activity;
b. violate, or assist in the violation of, any sanctions programs administered by any governmental authority of the jurisdictions where we hold licenses;
c. unreasonably overload, detrimentally interfere with, or gain unauthorized access to our systems or other networks, or other activities that facilitate any of the foregoing;
d. infringe or violate, or induce or assist in infringement or violation of, any copyright, trademark, right of publicity or privacy or any other proprietary right of third parties or of ours (including with respect to Circle Digital Assets), including any activity that would cause marketplace confusion or damage the reputation for quality inherent in USDC and Circle’s other trademarks;
e. involve engaging or attempting to engage in any fraudulent act, scheme to defraud or deceive, or other financial crime;
f. involve engaging or attempting to engage in wash trading, front-running, insider trading, market manipulation or other forms of market-based fraud or deceit;
g. your use involves activities that are associated with high illicit finance risks and that facilitate any of the foregoing: any mixing service (a mixer or tumbler used to obscure the source of funds), darknet market (or any other service or website that acts as a marketplace for illegal goods), ransomware, illicitly operating peer-to-peer exchanger, illicitly operating exchanges, or other activities that facilitate any of the foregoing; or
h. any activity that Circle subsequently deems publicly to be impermissible for the provision of its services.
